Terms of service

These terms govern your use of Mentaiq AI (“Mentaiq”, “we”, “us”). By creating an account or using the service, you agree to them. If you don't agree, please don't use Mentaiq.
Who you are contracting with
Mentaiq AI is a service provided by DarkMode Studios, established in Sweden.

1. The service
Mentaiq turns study material you provide — documents, pasted text, and video links — into flashcards, quizzes, practice exams, notes, key concepts, and AI tutoring. Flashcard review is available on the free tier. Quizzes, practice exams, smart notes, and the AI Tutor require a paid subscription.
2. Your account
You must be at least 13 years old to use Mentaiq. You're responsible for keeping access to your account secure and for activity that happens under it. Tell us promptly at support@mentaiq.app if you believe your account has been compromised. One account is for one person; please don't share logins.
3. Your content
You keep all rights to the material you upload. You grant us only the licence needed to run the service: to store your material, process it (including via our AI provider) to generate study material for you, and display the results back to you. We claim no ownership, and we don't use your material to train AI models.
You confirm you have the right to upload what you upload — your own notes, materials you've licensed, or material you're otherwise permitted to use for private study. Do not upload content you have no right to reproduce.
4. Acceptable use
You agree not to:
- attempt to access another user's account or data;
- probe, scan, or test the security of the service, or bypass rate limits, CAPTCHA, or access controls;
- scrape the service, or resell or redistribute generated content at scale;
- upload unlawful material, malware, or content that infringes others' rights;
- use the service to cheat where doing so breaches your institution's rules — study material is a study aid, and academic-integrity policies are yours to follow;
- resell or sublicense access to the service without our permission.
We may suspend or terminate accounts that breach these terms.
5. Subscriptions, billing, and cancellation
- Paid plans are billed in advance and renew automatically each period until cancelled.
- Prices and VAT. Prices are shown in US dollars and are inclusive of any value added tax we are required to account for on your purchase. The amount you see is the amount you pay; we bear the VAT out of it. Your card issuer may apply its own currency conversion.
- Payments are processed by Stripe. By subscribing you authorise recurring charges to your payment method.
- Cancel any time from Settings → Billing. Cancellation stops the next renewal; your plan keeps working until the end of the period you've already paid for. We do not pro-rate partial periods.
- If a payment fails, we may retry and may suspend paid features until it succeeds.
- We may change prices with at least 30 days' notice before your next renewal. Continuing after that constitutes acceptance; otherwise cancel before it takes effect.
Your right to withdraw. If you are a consumer in the EU or EEA you have 14 days to withdraw from a new subscription without giving a reason — in Sweden this comes from the Distance Contracts Act (distansavtalslagen), which implements the EU Consumer Rights Directive. Consumers elsewhere, including the UK, have equivalent rights under their own law.
Because this is digital content supplied immediately, starting to use paid features counts as asking us to begin during that period and acknowledging that doing so reduces the withdrawal right: you may be charged in proportion to what you used before withdrawing. To withdraw, email support@mentaiq.app — a plain statement is enough, no form required. Nothing in these terms limits statutory rights that cannot be limited by agreement.
6. AI-generated content
Study material is generated automatically from your source documents. We design the system to stay faithful to what you upload, but AI output can contain errors, omissions, or misinterpretations. Verify anything you rely on for an exam against your original material. Mentaiq is a study aid, not a substitute for your course materials or teaching, and we do not warrant that generated content is accurate or complete.
7. Availability
We aim to keep Mentaiq available and dependable, but we don't guarantee uninterrupted service. We may modify, suspend, or discontinue features. If we discontinue a paid feature materially, we'll give notice and refund the unused portion of your current period.
8. Our intellectual property
The Mentaiq name, interface, and software are ours and protected by intellectual property law. These terms grant you a personal, non-exclusive, non-transferable right to use the service — not rights in the software itself.
9. Liability
To the extent permitted by law, the service is provided “as is”, and we are not liable for indirect or consequential losses, lost data, lost profits, or academic outcomes. Our total liability in any 12-month period is limited to the amount you paid us in that period. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.
10. Ending the agreement
You may stop using Mentaiq and delete your account at any time from Settings → Profile; deletion removes your data and cancels any active subscription. We may suspend or terminate your account for breach of these terms, or with reasonable notice for other reasons.
11. Changes to these terms
We may update these terms. For material changes we'll update the date above and notify you in the app or by email before they take effect. Continuing to use Mentaiq afterwards means you accept the revised terms.
12. Governing law and disputes
These terms are governed by the laws of Sweden, and the Swedish courts have jurisdiction. If you are a consumer, this does not deprive you of the protection of the mandatory consumer law of your own country of residence, and you may bring proceedings there.
Out-of-court dispute resolution. If we can't resolve a complaint between us, consumers can refer the matter free of charge to the Swedish National Board for Consumer Disputes, Allmänna reklamationsnämnden (arn.se). Consumers elsewhere in the EU can contact their local European Consumer Centre. We will take part in such proceedings.
